I. Scope and Applicability of Privacy Policy

This Privacy Policy applies only to the Clarient Global LLC and its affiliates (collectively called “Clarient”) website (“Website”). The Privacy Policy sets forth the general policies and procedures of Clarient and our service providers with respect to the collection, use, disclosure, transfer, and safeguarding of personal information and other information collected by Clarient in connection with the operation of the Website and the provision of services related to the Clarient system (the “Services”) from users of the Website (“Users”).

Clarient may change this Privacy Policy from time to time, including as necessary or appropriate based on (i) results of testing and monitoring; (ii) changes to the business and operation of Clarient and the Services; and (iii) changes to regulations/laws. Changes will become effective upon the posting of the revised Privacy Policy to this Website. We will note the effective date of the most recent revision above.

II. Collection, Use, and Disclosure of Information

In connection with the Services, Clarient collects personal information from Users of the Website, including but not limited to names, email addresses, telephone numbers, and firm names. Clarient also collects non-personal information, such as various regulatory representations, provided by Users.

Clarient and its service providers may use Users’ personal information and other information to carry out the Services for which the personal information or other information was provided or for a transaction related thereto, to maintain accounts, to provide confirmations and statements, to provide access to data services, to combat fraud or any other criminal activity, for record keeping purposes, as otherwise required or permitted by law, and/or for any other purpose with your consent. As part of the Services, Clarient will share Users’ personal information and other information with those entities designated by Users to receive such information (“Designated Entities”). Clarient may disclose Users’ personal information and other information:

  • to our subsidiaries, affiliates, and worldwide offices
  • to selected service providers who act on Clarient’s behalf
  • to comply with the law or in response to a subpoena, court order, law enforcement or government request, or other legal process, including to assist duly authorized regulators;
  • to produce relevant documents or information in connection with litigation, arbitration, mediation, adjudication, government or internal investigations, or other legal or administrative proceedings;
  • if Clarient determines in its good faith judgment that such disclosure is necessary to provide its services or to protect the rights, interests, safety, or property of its business, employees, suppliers, customers, or others;
  • in connection with any proposed or actual sale or other transfer of some or all assets of Clairent, and/or any proposed or actual sale or merger of Clarient or any division of Clarient;
  • to enforce the terms of any agreement with Clarient;
  • to combat fraud or other criminal activity;
  • for any other purpose disclosed by us when you provide the information;
  • as otherwise permitted or required by law; or
  • with your consent

It is the policy of Clarient not to disclose Users’ personal information to third parties for such third parties’ own marketing purposes.

III. Information Safeguarding

Clarient and its service providers have implemented reasonable administrative, technical, and physical measures designed to protect User information from accidental loss and from unauthorized access, disclosure, use, alteration, or destruction. Clarient’s security protections use technology consistent with current industry standards as existing from time to time. Clarient’s service providers receiving User information are expected to maintain privacy and security protections that are consistent with Clarient’s privacy and information security policies.

It is the policy of Clarient to restrict access to Users’ personal information to those staff members who need to know such information in order to provide the Services or as otherwise appropriate and consistent with this Privacy Policy. Any staff member who is authorized to have access to such information in connection with the performance of such staff member’s duties and responsibilities is required to keep such information secure and confidential. Staff members are instructed to review materials setting forth Clarient’s policies and procedures and to comply with procedures that are designed to address administrative, technical, and physical safeguards for the protection of such information.

IV. Transfer of Information to Other Countries

In accordance with applicable law, personal information and other information covered by this Privacy Policy may be transferred to, and processed and stored in, the United States or any other country in which Clarient or its affiliates, subsidiaries, service providers, business partners, Users, or customers maintain facilities or reside, even if the level of data privacy required in that country is less than that required by your country. By submitting personal information to Clarient, Users consent to such transfers and to the worldwide processing of their personal information consistent with the terms of this Privacy Policy.

V. Accessing and Updating Information

Users have the right to request details of the personal information that Clarient holds about them and to delete or rectify any inaccurate personal information by sending a written request to privacyoffice@clarientglobal.com. While Clarient will make reasonable efforts to accommodate your request, we also reserve the right to impose certain restrictions and requirements on such access requests, if allowed or required by applicable laws.

VI. Use of Cookies and Other Electronic Tools

This Website uses cookies and other electronic tools to collect statistical and other information about your use of this Website. We collect and share this information only in non-personally identifiable format. The information we collect using these tools includes which operating system and browser you use, IP addresses, how you navigate to and through our site, and how long you stay on our web pages, among other information. We may share this information within Clarient and with our service providers in order to improve our Website and Services and enhance functionality for Users.

You acknowledge that information collection or privacy practices of any other party are not monitored or controlled by Clarient and Clarient is not responsible for such websites.
